Unregulated Construction and Hill Cutting

Environmental journalist Chandrani Sinha filed a Public Interest Litigation (PIL) in November 2025, highlighting the rampant and unregulated construction activity in Darjeeling. The PIL alleged that high-rise buildings, often constructed by cutting into hill slopes, were being built in violation of existing building rules and without adequate environmental safeguards.

Ecological Concerns and Seismic Risks

Darjeeling, a region classified under high seismic risk and prone to landslides, faces increased vulnerability due to this unchecked development. The petitioners argued that the proliferation of such structures could prove catastrophic during an earthquake or extreme weather event.

North East Connection

The environmental degradation in Darjeeling has implications far beyond municipal boundaries, affecting the entire North Bengal. As Chatterjee, the senior advocate for the petitioners, emphasised, "If we lose the hills today, tomorrow the entire North Bengal will face the consequences." This issue is not only relevant to Darjeeling but also to the North East region, which shares similar geographical and ecological characteristics.

Disaster Preparedness and Judicial Action

The PIL situates the issue within the broader context of disaster preparedness. Darjeeling lies in a high seismic zone and has a long history of landslides. The petition argues that unplanned construction, particularly vertical expansion without regard to slope stability or carrying capacity, significantly heightens the risk to life and property. The court's interim order, directing a complete halt to illegal construction, could be a significant step towards improving disaster preparedness in the region.
